Factoring & Asset-Based Lending

Whitaker Chalk has been working with factors and asset-based lenders for a number of years.  We represent clients throughout the United States.  Whitaker Chalk serves all of our factoring and asset- based lending clients’ legal needs including handling litigation, structuring deals, preparing documents, and representing clients in bankruptcy.

We provide the following services:

  • Structuring and documenting all types of transactions from original fundings to take out/buy out agreements, participations, and subordination agreements
  • Litigating claims with clients, account debtors, and secured parties
  • Navigating bankruptcy issues including filing claims, defending preferences, objecting to confirmation, negotiating cash collateral orders, and providing debtor-in-possession funding
  • Advising on lien priority issues including UCC-1 filings and “hidden” liens.

Our attorneys have been actively involved with the International Factoring Association, The Finance Forum and Commercial Finance Association for many years and have written numerous articles and presented speeches.
